This privacy policy (hereinafter, “Privacy Policy”) has been made by Adamant Renewables Holding, S.L. (hereinafter, “Adamant”, the “Controller” or “Us”) in order to comply with the duty of transparency in the processing of personal data that we collect as controller, in accordance with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter, “GDPR”) and the Dutch Implementation Act (hereinafter, “UAVG”) / Spanish Organic Law 3/2018 on Data Protection and Guarantee of Personal Rights (hereinafter, “LOPDGDD”).
The information contained in this Privacy Policy allows you to consult the details of the different processing of your personal data as a result of accessing and using our platform ’ADAMANT REPOWER’, consisting of a website and a mobile application (hereinafter, collectively the “Platform”), as well as the different relationships, legal or commercial, that you may have with Adamant.
I. NEED TO PROVIDE PERSONAL DATA
The use of some services or functionalities of the Platform does require you to provide certain personal data, indicated in the corresponding forms or contract models, and implies their processing for the purposes and on the bases of legitimacy indicated in this Privacy Policy.
Refusal to provide the data required in these cases may make it impossible to provide you with certain services or functionalities, or to process the requests or contracts made, especially in those cases in which they are identified as mandatory.
As the data subject, you are responsible for ensuring that the data you provide us with through the Platform are true, accurate, complete and up to date. For these purposes, you are responsible for the veracity of all the data you provide, and you must keep the information provided duly updated, so that it corresponds to your real situation.
You will also be liable for any false or inaccurate information that you provide and for any direct or indirect damages that this may cause to the Controller or to third parties.
Under no circumstances may personal data corresponding to third parties be submitted unless you have previously obtained their consent, and you will be personally liable for any failure to comply with this obligation. You may be asked to provide proof of this authorization at any time.

This way, the processing is necessary to allow the proper processing of your requests for information, resolution of your doubts, answering your queries or the processing of your claims and to verify the operation of the service in accordance with the established procedures, as well as to obtain evidence of the content of the requests received and the reason for the processing of the personal data that you may provide.

2. SIGN UP
When you sign up on the Platform, log in as a registered user, and manage your user profile and its related features, your data will be processed to carry out these activities on the Platform.

3. MONITOR CHARGING SESSIONS ON OUR CHARGERS
When using our Platform, Adamant offers you to monitor the session, which allows you to find the charging stations that are nearest to you and inform you of the charging status of your vehicle in real-time. This functionality enables Us to know which charger you are using and for how long you are using it.
The legitimate basis is the performance of the contractual relationship between Adamant and the user. On the other hand, the legitimate basis for geolocation is your consent, expressly provided in the App.
4. MAKE TRANSATIONS
Before using one of the chargers in our network, Adamant allows you to pay through the Platform.

5. CUSTOMER MANAGEMENT
When you sign a contract with Adamant, your personal data will be processed for the purpose of formalizing, managing, maintaining, developing, and controlling the provision of the services and the operation of the products contracted.

6. COMMERCIAL PROMOTION
In the event that you consent to the processing of your data for commercial purposes, Adamant will process the personal data collected for the purpose of sending you, by any means of communication: postal, telephone or electronic (including WhatsApp, email, SMS, etc.), offers and commercial information related to the products and services offered on the Platform, which may include the preparation and sending of a quote in accordance with the information provided for its calculation, follow-up of the same, and any communication related to the quotation sent. The legitimate basis described is the consent, which you have the right to withdraw at any time by sending an email to. Likewise, we inform you that the withdrawal of your consent will not affect the lawfulness of the processing based on the consent prior to its withdrawal.
Likewise, if you are already a customer, Adamant may send you commercial communications about products or services similar to those previously contracted, basing the legitimacy of the processing on Adamant’s legitimate interest in promoting its image through commercial communications. In any case, we remind you that you may object at any time to the processing of your data on the grounds of legitimate interest, in accordance with the provisions of the "Rights of the data subject" section of this Privacy Policy.

When you consent the processing of your data provided through the installation of data storage and retrieval devices (hereinafter, the “Cookies”) for statistical purposes when you access the Platform, these will be used for aggregate data reports, for statistical and analytical purposes by Adamant, as indicated in the Cookies Policy.
The legitimate basis is the consent, which you can withdraw at any time by sending an email to privacy@adamantrenewables.com. Finally, we inform you that the withdrawal of consent will not affect the lawfulness of the processing based on the consent prior to its withdrawal.

V. HOW LONG WE STORE YOUR PERSONAL DATA
As a general rule, when the personal data is no longer necessary for the purposes for which they were collected, they will be blocked and will be made available only to the competent authorities for the attendance of legal responsibilities arising from the processing, always in accordance with the applicable regulations, and may not be used for different purposes. Once the corresponding retention periods have elapsed, such personal data will be deleted in accordance with the applicable regulations.
In particular, the data collected for the purposes of app registration and other purposes based on the performance of the contractual relationship will be blocked for a period of five (5) years from the finalization of the event, after which it will be erased.
As per the data processed based on consent, these will be blocked until consent is withdrawn by the data subject. Finally, when it comes to the data processed based on legitimate interest, such will be processed until the data subject objects to such processing and/or, where applicable when data are no longer necessary for the purposes for which such were collected.
VI. WITH WHOM WE SHARE YOUR PERSONAL DATA
Adamant may need to share your personal data with third parties from time to time. In particular, Adamant may share your personal data with the following recipients or categories of recipients:
- Public bodies and authorities, for the fulfillment of legal obligations, where applicable.
- Spirii ApS for technical assistance and charging behavior to offer a personalized service.
Additionally, some providers contracted by Adamant, such as, among others, developers or hosting service providers, may have access to your personal data. However, Adamant has signed the relevant agreement with each third party, ensuring the security of your personal data.
In all these cases, Adamant guarantees that such access will be carried out exclusively for the purposes described in this Privacy Policy, in accordance with the data protection regulations and complying with all the technical and organizational measures necessary to ensure the security and confidentiality of your personal information.
VII. PROCESSING OF YOUR PERSONAL DATA OUTSIDE THE EUROPEAN ECONOMIC AREA (EEA)
Your personal data may be processed outside the EEA from time to time. This may happen, for example, in those cases where we need to share your data with other entities for the provision of any of the services described above.
More specifically, when the processing of personal data involves the transfer of such data to third countries established outside the territory of the European Economic Area (EEA), Adamant shall ensure that such transfer has adequate guarantees for the processing of personal data, taking into account the exposure to the risk of the data subjects, in accordance with the mechanisms provided for in the applicable regulations in order to guarantee an adequate level of security. Consequently, international data transfers in this regard may be carried out to the United States, exclusively for the purposes of cloud computing and email management, which, in all cases, shall be performed in compliance with the provisions of the General Data Protection Regulation.
VIII. YOUR RIGHTS
As the data subject, you have the right to contact the Controller at any time and free of charge, by writing to the addresses indicated in this Privacy Policy, to exercise the following rights:
- Right of Access: You have the right to be informed by the Controller whether or not your personal data is being processed and, if so, to have access to such data and to receive information on the purposes for which the data is being processed, the categories of data affected by the processing, the recipients to whom your personal data was disclosed and the intended period of retention of the data, among other information.
- Right to rectification: At any time, you may ask the Controller to rectify, without undue delay, any inaccurate personal data, as well as to complete the data.
- Right to withdraw consent: You may revoke the consent at any time and without the need for any justification. The revocation will not affect the lawfulness of the processing previously carried out.
- Right to object in whole or in part to processing: You have the right to object to the processing of your personal data in certain circumstances. In such cases, the Controller will stop processing the personal data, unless it can demonstrate compelling legitimate grounds for the processing which override your interests, rights, and freedoms, or for the formulation, exercise, or defense of claims.
- Right to data portability: You have the right to receive the personal data you have provided to the Controller in a structured, commonly used, and machine-readable format, and to be able to transmit them to another data controller without being prevented from doing so by the data controller to whom you have provided them, when legally provided for this purpose.
- Right to restrict processing: In certain circumstances (e.g., where the applicant disputes the accuracy of his or her data, while the accuracy of the data is being verified), you may request that Controller restricts the processing of your personal data, which will only be processed for the purpose of pursuing or defending claims.
- Right to erasure: You have the right to request the deletion of your personal data if the applicable legal requirements are met, inter alia, if they are no longer necessary for the purposes for which they were collected.

You hereby guarantee that the data you provide to Adamant is true, accurate, complete, and up to date. For these purposes, you, the user, are responsible for the veracity of all the data you communicate and will keep the information provided suitably updated.
Likewise, you guarantee that, in the event that you provide information from third parties, you have informed them of the aspects contained in this document. You also guarantee that, should this be the case, you have obtained express authorization to provide those data to Adamant.
You shall be responsible for false or inaccurate information provided to Adamant, and for all damages, direct or indirect, that this may cause Adamant or third parties.
X. SECURITY MEASURES
Adamant will always process your personal data in a confidential way, in accordance with the applicable laws and regulations.
For these purposes, Adamant has implemented appropriate technical and organizational measures to ensure a level of security appropriate to the risk, in particular from accidental or unlawful destruction, loss, alteration, unauthorized disclosure of, or access to personal data transmitted, stored, or otherwise processed.
Adamant takes, to this end, into account the state of the art, the costs of implementation, and the nature, scope, context, and purposes of processing as well as the risk of varying likelihood and severity for the rights and freedoms of natural persons.
XI. UPDATE OF THIS PRIVACY POLICY
We may, from time to time, need to update our Privacy Policy. All amendments to this Privacy Policy will be available here. In case of relevant changes, you may receive a notice, either by email, post, or other appropriate means.
